General Terms and Conditions
Vgo Associates was born with the aim of creating “functional sculptures” that privileges the message it describes with itself rather than hedonism, aesthetics or style, to give life and counterculture that stands out from the prevailing materialism of the last century.
Our project is a gallery (“Gallery”) that deals with a new type of collecting and a new type of design; the Alchemical Design. The Gallery provides, as a broker, a service of viewing, selling and buying original works of art (“Services”) through the website [www.*] (“Website”).
Application of General terms and conditions
These General terms and conditions (“GC”) regulate the business relationship between you (or “Buyer”) and us (or “VGO”).
By using Our Web Site in any way, or by buying from us, you agree to be bound by them.
We reserve the right to modify these GC at any time and without prior notice. By continuing to access, use the Website or to use our Services after we have posted a modification or have provided you with notice of a modification, you are accepting to be bound to the modified GC
We encourage you to check back regularly to review these GC.
Account and Access
The Website and Services are available for persons who are eighteen or older. By accepting these GC you represent and warrant that you are eighteen or older.
You will be required to have a register account in order to use our Service. You must complete our registration process. During that process, you will be required to provide certain information including but not limited to: Name, Surname, email, shipping address. You agree to provide accurate, current and complete information during the registration process. We reserve the right to suspend or terminate your Account if any information provided during the registration process of thereafter proves to be inaccurate, not current or incomplete.
The permission we give you to use our Service under these terms is non-exclusive and not-transferable. You are not allowed to rent, sell, lease, sublicense or otherwise transfer your account, or any access to or use of our Services, to any third party.
Purchase Terms and Conditions
As a Buyer of a work of art, you will be the Principal that demand to be supplied with certain goods that are made according to your personal specifications and clearly customized. Every piece is unique because handcrafted on request. When you purchase an artwork shown through the Website, you are purchasing the work from its producer/artist, for which the Gallery operates as a broker. Prices for an artwork will be as specified on the applicable listing on the Website.
You acknowledge that price not includes shipping and not includes handling charges or applicable taxes, if any, for which you are liable and which will be separately identified on the website cart. You are also liable for paying international customs fees, determined by the country the artwork is being shipped to. Please check with your country’s customs office to determine what these additional costs will be prior to making a purchase.
Gallery will collect your billing and shipping information and process your payment. The producer identified on the listing of the original artwork will ship the purchased work directly to the Buyer.
Pursuant to the art. 59, l. c, Legislative Decree 6 September 2005 no. 206 (Consumer Code), as modified by L.D. 21/2014 (European Directive 2011/83/UE) no money-back guarantee is applicable to our items, since they are:
- commissioned artwork;
- artwork realized on demand.
The Buyer is liable for the cost of the return shipping.
We reserve the right to cancel any order for an artwork if we determine, at our sole discretion, that the item is mispriced, out of stock or otherwise unavailable at the price listed via Website. If we cancel an order placed, we will send you an email confirmation of such cancellation and you will not be charged for your order.
You will be required to pay the price of the artwork in advance by debit card or credit card Visa, Matercard, bank wire as well as PayPal account balances. Even thought all prices are in Euro, you can pay in every currency PayPal accepts. Credit/Debit card payments and bank transfers may be subject to additional charges, which must be borne by you in addition to the cost of the artwork. We do not collect any numbers or other data relating to Credit card payment service providers.
By placing an order, you consent to be charged with the price. Afterwards we will send you a confirmation email of your order to the email address you provided.
We cannot be held liable for any damages incurred by the user due to the misuse of the Credit or Debit card.
All artwork is shipped directly form the producers via “Carrier”.
Deliveries will be made by the Carrier to the address indicated in your order. You must ensure that someone is present to accept delivery.
Producer is liable for shipping. If the artwork arrives damaged, we will hold the Producer liable for damages.
copyrights and other intellectual property rights
The Artist guarantees that the artwork submitted to the Gallery is original work and does not infringe the copyright or other intellectual property rights of any third parties.
governing law and dispute resolution
This agreement shall be governed by and construed in accordance with the law of Italy. This agreement shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is hereby expressly excluded.
In the event of a dispute arising out of or in connection with these terms or any contract between you and us, then you agree to attempt to settle the dispute by engaging in good faith with us in a process of mediation before commencing arbitration or litigation.
Any dispute or claim in connection to or arising from these GC shall be subject to the exclusive jurisdiction of the Firenze (IT) Court. Any action concerning any dispute with respect to the Services must be commenced within one year after the cause of the dispute.
